Automatic stay: pause for seizure

The Court immediately issues a relief order when you file a request for a default in Chapter 13 or Chapter 7, which involves something beautiful, known as an automatic stay. Auto-stay instructs creditors to stop collecting activities immediately and without explanation. If your house is due to be foreclosed, sales will typically be postponed for 3 to 4 months, as bankruptcy is pending. However, there are two exceptions to this general rule:

Movement for an extension in the length of the stay: if the claimant requires the bankruptcy court’s consent for sale (by filing a motion for revocation of the residence), no more than three or four months of the stay shall be given. But even then, if the lender applies for an exemption from residency, bankruptcy will typically postpone sales by at least two months or longer.

Compliance Notice already filed: unfortunately, automatic default does not stop with a warning that most countries require until a foreclosure can be made (or a request for deferment can be created). For example, a lender must notify the landlord at least three months before selling a California home. If you receive a default notice of three months and file for bankruptcy after two months, the default period expires after just one month. The lender will then apply for suspension of residency and obtain permission from the Court to schedule the forfeiture sale.
