The foreclosure method varies from state to state, but it is usually very simple and takes up to six months. The process depends on whether the mortgage is an out-of-court sale or a court sale.

  1. Until foreclosure: the property is in the pre-foreclosure process after the owner has skipped two or three mortgage payments (30-60 days). Usually, when the property is pre-foreseen, the lender may send a formal letter asking for immediate and full payment of the loan and any reasonable and overdue costs.
  2. Default Notice: Foreclosure starts after 90 days of non-payment by the owner. A bank shall give a default notice to the local sheriff for delivery by the owner. The government agency shall record the default notice and the date chosen for the foreclosure sale. The default notice often offers buyers and other homeowners a chance to negotiate a short sale.
  3. Closing auction: a public auction is open, and the property will be sold to the highest bidder. The defaulting lender could also purchase and sell the property individually in a private sale. The owner must leave the property or, whether he or she is still living on the property after the sale, an unconstitutional bond may evict the owner.

  1. After foreclosure: if the sale proceeds are not sufficient to compensate for the debt foreclosed, the lender will lodge a legal claim against the creditor of the owner for the deficiency. In some cases, the borrower may be responsible for compensation after default by paying the full purchase price.
  2. Right of redemption: the lender or mortgage holder can, in any event, repay the property by paying the amount due before the selling of the foreclosure. This is also the right to withdraw. If the mortgage has a facilitation clause, the entire mortgage balance must be refunded until it is repayable to the lender.
