EXCERPT:

Based on the facts of this case, the applicable law in effect at the time
the instant suit was initiated, and the clear precedent of Vukman, we
conclude that the trial court lacked subject matter jurisdiction in this
mortgage foreclosure action. Accordingly, the judgment entered on
November 18, 2011, and the assessment of damages entered on December
19, 2011 are vacated as null and void, and BOA’s complaint is dismissed
without prejudice. As our disposition renders Appellant’s remaining issues
moot, we need not address their merits.

Judgment vacated. Complaint dismissed without prejudice.
Jurisdiction relinquished.
