Clouded Titles-
In the past, many website operators (hell bent on a cause to stop foreclosures) have pontificated the idea that “you don’t own your own home”. I beg to differ, based on my understanding between legally getting one’s name on a deed to any piece of property in America or not.
These well-meaning but internally-misconstrued tirades have largely been proliferated throughout “the system” due to (sadly) partial ignorance of all of the facts about the infiltration (in the past 15 years) of a so-called “national book entry system” and/or “electronic database” that claims to be contractually superior (by inference) to statutorily-mandated county recordation systems, by the contractually-inserted phrase “hold legal title” (as to the interests granted by the Borrower). Unfortunately, the misrepresentations of this entity have distorted more than just the term “legal title” but have also attempted to misrepresent and misconstrue the term “equitable title” by substituting the term “beneficiary” as if to give the entity’s business model some sort of legal credence to exist (just because it says so).
