The motion for Bankruptcy in Chapter 7 defers foreclosure but does not block it indefinitely. When you apply for Bankruptcy, all eviction proceedings must be stopped due to self-residence. A stay acts as a court order or disincentive to creditors’ efforts to reclaim debts or request mortgages.
Chapter 7 Bankruptcy, please. Bankruptcy Though you will not make up for past-due mortgage payments in Chapter 7, this will allow you to delay the default. Generally speaking, it is not a good idea to file Chapter 7 if you do not have a lot of debt or debt that can be forgiven, and the only justification for petitioning is for you to have more time at home. You can’t get another Chapter 7 exemption for eight years. Why would you want this option to give you a little extra time before you eventually lose your home? Also, the courts refuse to consider applicants who make tactical use of Bankruptcy. However, if you have significant debt problems and you can get rid of the debt through Chapter 7 bankruptcy, it can make sense to file and have more time at home.
Bankruptcy, of course, is not for everyone. Psychological barriers are obvious; nobody wants to accept that Bankruptcy is essential. And if you’re desperate to get your bankroll back as soon as you can, your best bet is to quit bankrupt.
Time is the answer. Timing is quite critical. If you first see a lawyer a few days before the scheduled foreclosure auction, the lawyer can do nothing other than file for Bankruptcy to avoid the auction. If you see a doctor as soon as you hear of a possible seizure, you have a much better chance of managing to stop attacks. Before the insolvency proceedings, reform is required.
