Boy oh Boy… I think everyone in Florida needs to examine, re-examine exactly what the heck is going down there. All this funny business is beginning to seem like the new norm.

St. Pete Times-

TALLAHASSEE — For a second time, e-mails to and from Florida Gov. Rick Scott have been deleted in possible violation of state law.

Scott’s team acknowledged in August, months after a Times/Herald request for transition records, that dozens of e-mail accounts had been deleted from a private computer server where the documents were stored.

Now, Scott’s office has confirmed e-mails stored on Scott’s iPad were deleted when a Governor’s Office staffer in charge of technology tried to print the documents. Both incidents have been described as accidental.

The e-mails run the gamut from details on Scott’s new stationery to the hiring of agency heads to meeting a Florida Supreme Court justice.

Tampa Bay-

The e-mail accounts of Rick Scott and most of the governor-elect’s transition team were deleted soon after he took office, potentially erasing public records that state law requires be kept.

Scott’s team acknowledged for the first time this week that the private company providing e-mail service deleted the records as early as mid January, about the time the Times/Herald first sought transition e-mails.

Yves Smith has an interesting post up on Naked Capitalism about Florida Governor Rick Scott suggesting that Florida could switch from judicial to nonjudicial foreclosures as a way to solve its foreclosure overload. (At a Congressional hearing last fall, the head of BAC testified that 70% of judicial foreclosures are in Florida, a testament to that state’s high default rate and large population among judicial foreclosure states.)

Putting aside the political questions of whether should engage in such a change and whether the votes are there, I think there’s a really interesting legal question lurking in the suggestion. Can a state change from judicial to nonjudicial foreclosure as applied to existing mortgages? (Let’s assume that it would only apply to future foreclosures, however.)

Governor Kevin Warsh resigns from Board of Governors of the Federal Reserve System, effective on or around March 31, 2011


Kevin Warsh announced his intent to resign as a member of the Board of Governors of the Federal Reserve System on or around March 31, 2011.

Governor Warsh, a member of the Board since February 2006, submitted his letter of resignation to President Obama today.

“Kevin rendered the Federal Reserve and the nation exemplary service during his time at the Board,” Federal Reserve Board Chairman Ben S. Bernanke said. “In particular, his intimate knowledge of financial markets and institutions proved invaluable during the recent crisis. And he worked energetically and effectively behind the scenes overseeing the operations of the Board and the Federal Reserve System. I deeply appreciate his insights and wise counsel and, most especially, his fortitude and friendship during the difficult days, nights, and weekends of the crisis.”

Warsh has focused most significantly on issues related to financial markets and the conduct of monetary policy.

Warsh has served as the Federal Reserve’s representative to the Group of Twenty and the Board’s emissary to the emerging and advanced economies in Asia. In addition, he has served as Administrative Governor, managing and overseeing the Board’s operations, personnel, and financial performance.

Prior to his appointment to the Board, from 2002 until 2006, Warsh served as Special Assistant to the President for Economic Policy and Executive Secretary of the White House National Economic Council.

DinSFLA here: I agree 100%. Where are the sirens that should be going off and a Foreclosure Moratorium? This is not the first time nor the last time we will hear of financial institutions with the help of LPS and MERS fabricating documents. .

We will not rest until we see justice and these politicians doing the job they took an oath for!

Sink, McCollum, Scott–Three the Hard Way

Some highlights to this article from the West Orlando News:

Bill McCollum is the Florida Attorney General, allegedly Florida’s top cop, and Alex Sink is Florida’s Chief Financial Officer or Florida’s chief financial crime investigator.

Well, history is the best teacher. If you want to know if Sink and McCollum will “fight” for you as Governor, let’s see how they “fought” for you as members of the Florida Cabinet.

It’s common knowledge that the State of Florida is one of America’s safest havens for predatory lenders, ponzi schemers and financial crooks. Florida was home to the Madoffs and Rothsteins, and a favorite spot for the Wells Fargos and Freemont Investment and Loan companies that swindled thousands of Floridians out of their investments and concocted illegal residential foreclosure actions.

Fight for me as Governor? I don’t think so! What financial criminals has Sink investigated? What financial criminals has McCollum prosecuted?

Don’t take my word for any of this. Read the facts for yourself. Call your little politicians and say Lucius is talking about them and see how they respond.

Both Sink and McCollum should know or should have known that financial criminals were not only robbing individual citizens, the crooks were also playing loose and free with money that the financial criminals owed local governments for transfer fees, assignment fees and other government financial transaction fees.

There is an electronic recording system devised by and for the convenience of predatory lenders and financial criminals called “MERS”. This system allows financial crooks to “document” changes in property title ownerships.

Both Sink and McCullom knew or should have known that the use of MERS to document or change titles, transfers and assignments of properties in Florida is illegal.

Why? Because use of MERS breaks the chain of title, allows criminals to get away without paying local government fees and is an explicit and factual violation of Florida Law!

Florida Statute 701.02 specifically states that “(1) An assignment of a mortgage upon real property or any interest therein, is not good or effectual in law or equity, against creditors or subsequent purchasers, for a valuable consideration, and without notice, unless the assignment is contained in a document that, in its title, indicates an assignment of mortgage and is recorded according to law.”

When Sink and McCollum got complaints from Florida citizens that claimed they were being victimized by predatory lenders and financial criminals, it seems they both ignored those complaints.
