According to a Handwriting Expert… yes, documents were forged and altered.

As if Breaking and Entering weren’t enough, add forgery to the lengths JP Morgan Chase will go to take a home.

When foreclosure proceedings began on William Paatalo’s  Montana property in  January 2010, he, like many homeowners, felt emotionally drained and devastated. “ I couldn’t believe how I got to this place.  I had perfect credit in 2008.  I was making payments on three properties through Washington Mutual, but they began to misapply payments to the wrong accounts and even turned off my ‘auto-pay’ feature in an attempt to sabotage my credit and spin me into default.”

  By the time Paatalo discovered the error, his credit had tanked and things started spiraling downward. “It was brutal. My business lines of credit were shut down, and I couldn’t access any of my lines of credit ; WAMU was slow to acknowledge the problem; the credit agencies ignored me; and then I got the foreclosure notices.  It was a living hell. I spent a lot time being angry. “

In the end, Paatalo did what many home owners  are now doing.  He started pushing back.  “I didn’t want to just roll over.  I figured I still had some rights, so I began the painstaking process of researching my loan in hopes I could modify or delay the action.  The Trustee’s sale wasn’t   scheduled until June, so I figured I had a little bit of time to rectify the situation.”

But unbeknownst to Paatalo, Chase, who had acquired WAMU in 2008, took early action.  In March, they broke into his home, changed all the locks, and stole property, including  personal documents and a handgun.  “I was out of town, and when I found out what they had done I was outraged.” 

Paatalo filed a criminal complaint and took additional action. However, law enforcement sat idle as it was perceived to be a “civil matter.”  Tired of being victimized, he began investigating practices in the mortgage industry and uncovered much of what is now known.  In October of 2010 he filed suit against JP Morgan Chase pro se and has been litigating since then. 

But his case, scheduled for trial in September, took a bizarre turn recently.  “I was reading about the class action suit in California Bakenie v. JPMorgan Chase Bank  and I got to wondering if my note might’ve been forged.  So I got a color copy of the note, and in my office I magnified the signatures 800 fold.”

What he found was astounding.  Even to the layman’s eye, the signatures appeared to have been photo-shopped.  In one instance, even the signature line was colored blue.  “I couldn’t believe what I was seeing.  It looked like something a high school kid did. 

 Paatalo sent the document to Dr. Laurie Hoeltzel  in southern California;  a handwriting / document expert with over 20 years of experience.  Her findings verified what Paatalo suspected, the documents had indeed been forged.  “All along Chase has argued on record they hold the note.  Clearly, they do not.  It’s one thing to claim the note entitles them to foreclose, it’s another to commit a felonious act to illegally take a home they are not entitled to.  It’s absolutely appalling.  This is no longer a civil dispute.”

 Paatalo intends to file a criminal complaint against Chase, along with formal Bar complaints against their attorneys . The expert declaration is now in the hands of Montana’s Federal Magistrate Judge Carolyn  Ostby.   How this new information plays out in court is yet to be determined, but Paatalo is sure of one thing.  “Nothing these banks do surprises me anymore.  I can only hope our judicial system has the backbone to hold these people accountable.”

 Addendum:  Paatalo notified Chase of his discovery last week and was attempting to have the evidence surrendered to the court and sequestered.  After all, attorneys have a duty to uphold justice and refrain from assisting in fraud. He was notified today by Chase’s attorney that the documents had been removed from Butte, Montana and are now in Minneapolis, Minnesota.  Paatalo has objected to the transferring of the documents, and Chase’s attempts to withhold evidence of a crime.

Michigan Attorney General Bill Schuette has issued a second criminal investigative subpoena against DocX

Michigan Attorney General Bill Schuette has issued a second criminal investigative subpoena against national mortgage servicing support provider DocX as his office continues to investigate questionable mortgage documentation filed with Michigan’s Register of Deeds offices during the current foreclosure crisis.  

“We are moving forward with our investigative efforts to find answers on behalf of Michigan homeowners,” said Schuette.  

Schuette’s office has requested documents and information regarding DocX operations in relation to foreclosure and/or bankruptcy-related document processing. The subpoena was approved by the 54B District Court in Ingham County, and the information must be provided to the Attorney General’s Office on or before April 4.

This is the second criminal subpoena filed during the course of Schuette’s investigation. Schuette previously filed a criminal subpoena against DocX on June 12, 2011.

Southern Essex District Register of Deeds John O’Brien today is calling for a temporary halt on all foreclosures on Massachusetts homeowners until there is time to sort through the complex issues, including the fraudulent documents that have been recorded in people’s chains of title.  In addition, O’Brien has cautioned people that they should think twice before buying a foreclosed property in light of the recent Massachusetts Supreme Judicial Court Decision in Bevilacqua v. Rodriquez.

 Although O’Brien commended the Supreme Court and Judge Long for its sound decision in the Bevilacqua Case, he recommends that any lender, servicer or foreclosure law firm be required to attest in an affidavit, under the pains and penalties of perjury, that all the paperwork involved in a foreclosure has been reviewed by someone in authority at the bank with knowledge of the transaction and that the paperwork is correct, truthful and valid.  He believes that lenders should also have to prove, through a forensic audit, that they actually own the note and mortgage upon which they are foreclosing upon.

 The Bevilacqua Decision makes it clear that a lender must own the mortgage before it may foreclose. “As I have said all along, had Bank of America, J.P. Morgan Chase, Wells Fargo and others followed the law and played by the same rules as everyone else, maybe our economy would not be in this crisis today. There is a good reason that we have registries of deeds in this country.  It is so that every document that pertains to a parcel of real property is recorded in a public registry, so that anyone, at any time, may view their chain of title.”

“Since the property involved in the Bevilacqua Case is in Haverhill, which is a part of my district, I have reached out to our mortgage fraud and forensic analyst, Marie McDonnell of McDonnell Property Analytics.  Ms. McDonnell has certified to me that there are at least three missing assignments in the Bevilacqua chain of title, and that the one assignment which was recorded on the property is fraudulent.  This clearly demonstrates the damage to a chain of title when assignments are not timely filed or not filed at all.” said O’Brien.

 In calling for a halt on foreclosures, O’Brien said, “This will send a clear message that Massachusetts will not tolerate the practice of using fraudulent documents to put someone out on the street.  This is something that we do not do in America. We all have to remember that foreclosures are not good for anyone; they hurt families, neighborhoods, property values and therefore communities as a whole.  These big banks have played fast and loose with peoples property rights, and now courts in Massachusetts and other states are standing up and saying that what they have done is wrong.   Fraudulent documents are and always should be unacceptable and never be recorded in a registry of deeds.  If the average person recorded a fraudulent document and then attempted to present it to a court of law as evidence, they would be prosecuted. So it begs the question, why are the captains of the bank industry and Wall Street being treated differently? Let me make it clear that this fraudulent activity is being done by major lenders, not our local community banks.  I think that the lesson here is if anyone is currently looking for a mortgage, they should be dealing with their local hometown banks who have always played by the rules.” O’Brien continued, “Perhaps if people stop buying these foreclosed properties, which in most cases sell for less than what the original homeowner owed the lender, than maybe the banks will rethink their position and do the right thing, namely begin working with homeowners to create a new payment plan that will keep people in their homes.”

 In an attempt to provide people with more assistance, O’Brien is now offering any homeowner in his district who has a document in their chain of title signed by a known robo-signer, an affidavit signed by him as Register of Deeds attesting to the presence of that signature which has been recorded at his Registry. For those homeowners that are currently being foreclosed upon, this affidavit may be presented to their attorney, the lender or the court to show that their chain of title has been corrupted.  For those who are not in foreclosure, the affidavit may be presented to their current lender to show that a robo-signed document has in fact been recorded in their chain of title and be part of a request to investigate how this happened and what the lender is going to do to correct it. 

 Homeowners may check to see if there is a known robo-signer in their chain of title by visiting his website www.salemdeeds.com  or by calling his Customer Service Department at 978-542-1704.

Michigan Attorney General Subpoenas Three Mortgage Processors in Probe (LPS, FNF, CT CORP. SYSTEMS)

The Michigan attorney general’s office subpoenaed three mortgage processors including Lender Processing Services as part of a state probe of robo-signing.

Michigan Attorney General Bill Schuette said his office serviced Lender Processing, Fidelity National Financial Inc. (FNF) and CT Corporation System with investigative subpoenas as affiliates of DocX, a mortgage service support provider. The attorney general said he is seeking information about documents signed by DocX employees as “Linda Green.”

The subpoenas are part of a criminal investigation into questionable mortgage documentation filed with Michigan’s Register of Deeds offices, Schuette’s said in a statement today. The subpoenas were approved by the state court in Lansing June 13 and require responses by June 30, Schuette said.

LANSING- Michigan Attorney General Bill Schuette today announced that he has issued criminal investigative subpoenas against national mortgage servicing support providers in an expansion of his office’s investigation into questionable mortgage documentation filed with Michigan’s Register of Deeds offices during the current foreclosure crisis.

“Allegations of forged mortgage documents are very serious and require a thorough investigation,” said Schuette.  “I will continue to work closely with federal and local authorities to find answers on behalf of Michigan homeowners.”

The Attorney General is empowered to pursue criminal investigative subpoenas under the Code of Criminal Procedure (MCL 767A.2(2)).  Schuette’s office has filed criminal investigative subpoenas against DocX, which provides mortgage support services, including creating, processing or recording mortgage assignments or other mortgage documentation.  In addition to DocX, the following companies affiliated with DocX were served with investigative subpoenas by Schuette’s office:

·         Lender Processing Services, Inc.;

·         Fidelity National Financial, Inc.; and

·         CT Corporation System.

Schuette’s office has requested documents regarding the mortgage processing companies’ operations in relation to foreclosure and/or bankruptcy-related document processing.  The subpoenas were approved by the 54B District Court in Ingham County on Monday, June 13, 2011, and the information must be provided to the Attorney General’s Office on or before June 30, 2011.

In April 2011, Schuette launched an investigation after county officials across the state reported that they suspected Assignment of Mortgage documents filed in their offices may have been forged.  A recent “60 Minutes” news broadcast had shown that the name “Linda Green” was signed to thousands of mortgage-related documents nationwide, but with many different variations in handwriting.  County officials in Michigan reviewed their files and found similar documents, thus raising questions about the authenticity of the documents filed.

Schuette is investigating whether certain mortgage processing companies permitted such robosigning of legal documents filed in connection with Michigan foreclosures.  Apart from the question of whether falsified signatures were used, robosigning may also involve individuals signing affidavits to signify that mortgage documentation was properly prepared without ever conducting a proper review of the documents.  Although Michigan is a non-judicial foreclosure state, Schuette is reviewing whether robosigned documents may have been filed with courts in limited cases.

Schuette urges any current or former employees of mortgage servicers or processing companies with knowledge of unlawful practices related to mortgage servicing or the execution of documents in Michigan to call the Attorney General’s Corporate Oversight Division at (517) 373-1160 (517) 373-1160 .

Schuette is also continuing to work with fellow attorneys general in a national workgroup examining mortgage lending practices, including the robosigning issue and consumer protection concerns affecting homeowners nationwide.

Schuette reminds Michigan homeowners that citizens do not need to pay to speak with their lender or servicer or to obtain outside assistance with foreclosure issues.  Free local assistance with foreclosure issues can be found by calling the Michigan State Housing Development Authority at (866) 946-7432 (866) 946-7432.

Deutsche Bank has dropped the son of high-profile foreclosure fraud investigator Lynn Szymoniak from the foreclosure case against her, according to new court documents.

The bank had added Szymoniak’s son, Mark Cullen, to the foreclosure suit this May, a move that many experts saw as an act of retaliation against Szymoniak, who has publicized banks’ widespread use of forged signatures in the foreclosure process to improperly give borrowers the boot. On June 8, lawyers filed a “Notice of Dropping Party” with the Florida court dismissing its previous claims against Cullen.

The Ingham County Board of Commissioners in Michigan approved up to $60,000 in Legal Aid funding to represent borrowers affected by allegedly improper foreclosures and possible documentation fraud.

The county’s Register of Deeds Curtis Hertel Jr. uncovered potential fraudulent documents in his office calling into question hundreds of foreclosures. Hertel told HousingWire Wednesday he found 400 cases with possible fraudulent documentation involving Mortgage Electronic Registration Systems and another 100 involving DocX, a division of Lender Processing Services (LPS: 24.44 -1.89%).

But Deutsche Bank wasn’t just going after her. The bank was also attempting to sue her son, Mark Cullen, who is currently pursuing a graduate degree in poetry at the New School in New York. Cullen hasn’t lived in Szymoniak’s house for seven years and is not a party to any aspect of her mortgagehe has no interest in either the property or the loan, and never has had any such interest, according to Szymoniak.

And other Florida foreclosure experts say it’s difficult to interpret Deutsche Bank’s move as anything other than retaliation for Szymoniak’s media presence. If it is not, in fact, retaliation, they argue, then Deutsche Bank’s lawyers have demonstrated rank incompetence.

LANSING — The growing controversy over allegedly fraudulent foreclosure documents will receive a hearing Wednesday in the state House Banking Committee. The controversy has also prompted some public officials to call for repeal of Michigan’s foreclosure by advertisement process, and instead adopt a judicial foreclosure act.

The Bristol County Board of Commisioners voted unanimously Tuesday to send a letter to Massachusetts Attorney General Martha Coakley expressing interest in pursuing litigation against Mortgage Electronic Registration Systems, Inc, commonly known as MERS, for skirting public recording laws.

MERS is a private network that is partly owned by Bank of America. The commissioners did not specify how much they are looking to recover. “It’d be really rough numbers,” said Commissioner John Mitchell. “We’d have to find out.”

The 1960’s television show “To Tell the Truth”, where imposters pretend to be the central character, is playing out today at the Essex Southern District Registry of Deeds and Register John O’Brien is not happy about it. After the 60 Minutes’ expose on Mortgage Fraud was aired and showed that leading mortgage services have been using forged documents to foreclose on homeowners, Register John O’Brien reviewed mortgage discharges recorded in his Registry. What he found astonished him. In 2010 alone, 286 Bank of America’s mortgage discharges were recorded with what he calls “questionable and possibly fraudulent signatures of the notorious Linda Green.” O’Brien said that he has found at least four variations of Green’s signature recorded in his Registry.

Green, who was spotlighted in the 60 Minutes Episode, had her name signed by various individuals on thousands of documents recorded at Registries of Deeds throughout the state of Massachusetts and across the nation. In Register O’Brien’s opinion, these documents have corrupted Essex County homeowner’s chains of title. “I have a responsibility to ensure that the documents recorded in my Registry meet the statutory requirements of recording. If, however, I am presented with evidence that clearly shows that fraud may have been committed then it is my responsibility as the keeper of records to turn these documents over to the appropriate authorities for their review and action.”

O’Brien has today forwarded certified copies of these discharges to United States Attorney, Carmen Ortez, Attorney General, Martha Coakley, and Essex County District Attorney, Jonathan Blodgett. “If what I suspect has happened, then the people who have committed this fraud should be held accountable for their actions” commented O’Brien. O’Brien fears that this fraudulent behavior is only the tip of the iceberg and feels strongly that lenders and mortgage servicers should be held accountable for their actions. Actions which he originally only thought involved a scheme to circumvent the land recordation system by creating a private, for profit cyber-registry to benefit the big bank’s pocketbooks. Now it seems that MERS, and its member banks may have added fraud to their repertoire of services that they offer.

Register O’Brien questions if a good portion of this foreclosure mess could have been avoided in the first place, if the big banks did what they were supposed to do and recorded assignments like other lenders do. Register O’Brien believes: 1) Homeowners deserve to know who owns their mortgages; 2) Assignments should be recorded in the appropriate registry of deeds, each and every time a mortgage is sold, to provided transparency and public disclosure of ownership; and 3) Any and all documents should be signed by an authorized authority at the entity that actually owns and holds the note secured by the mortgage.

Register of Deeds Jeff Thigpen Uncovers Possible Fraud by Wells Fargo, Bank of America, and MERS

Guilford County Register of Deeds Jeff Thigpen will hold a press conference in the Blue Room in the Old Guilford County Courthouse on Wednesday, May 6th at 10 am  to reveal the findings of an internal investigation initiated after a 60 Minutes segment called “The Mortgage Paperwork Mess” that followed alleged fraud committed the company Doc X, owned by Lender Proccessing Services (LPS) and contracted with major mortgage and banking institutions including Wells Fargo, Bank of America and the Mortgage Electronic Registration Systems (MERS) Inc.

Register of Deeds Thigpen will be joined by Lynn Szymoniak, an attorney interviewed during the segment by 60 Minutes Scott Pelley.   The findings of this internal investigation will be revealed and forwarded to the appropriate federal and state agencies including the Federal Reserve, Federal Deposit Insurance Corporation (FDIC), Office of Thrift Supervision (OTS), and Office of Comptroller of the Currency (OCC).

The findings will be submitted to Iowa Attorney General Tom Miller, heading the 50 State Attorney General Investigations into Foreclosure Fraud, and North Carolina Attorney General Roy Cooper, current President of the National Association of Attorneys General for their consideration and the financial services institutions.

Register of Deeds Thigpen will also announce actions taken involving Lenders and Mortgage companies to address the findings of this investigation.

Ingham County Registrar of Deeds Curtis Hertel Jr. said last week that he had found at least 60 instances of such fraudulent documents in his office – documents presented by mortgage lenders as part of the foreclosure process.

He is not alone. Eaton and Clinton counties also reported questionable documents, and Oakland County Registrar of Deeds Bill Bullard wrote to Schuette about the problem earlier this week.
