Veteran files suit against Nationstar Mortgage after home placed in foreclosure

West Virginia Record-

A veteran residing in Charleston alleges that a mortgage servicer failed to modify a loan and placed his home into foreclosure.

John T. Baldy II filed a complaint in Kanawha Circuit Court against Nationstar Mortgage LLC, doing business as Mr. Cooper, alleging breach of contract and other counts.

The suit states that the plaintiff obtained a Veterans Administration loan for the purchase of a home on March 29, 2006. The plaintiff was married when he secured the loan but in 2007, the suit states the couple divorced. The plaintiff alleges the servicing and loan were assigned to the defendant in 2015.

The plaintiff alleges he experienced a hardship in 2017 that made it difficult to pay the loan and in September 2017, the defendant offered a loan modification that he accepted. He alleges the defendant breached the agreement and refused to modify the loan and that the defendant insisted the plaintiff’s ex-wife’s signature was needed on the modification documents. The plaintiff alleges there is no requirement in the law or contract for his ex-wife’s signature because she has no interest in the property.

    I agree with you about the signature very much so and I know how frustrating it might be to get a person you dislike very much to sign something for you. Like asking them for an organ donation or bone marrow donation right?

    My friend, I would do one of the following or all.

    1. Assume the mortgage with a refinance, as the percentage rates are great for the most part right now. CALL THE VA.

    2. Get a POA that states anything to do with the TITLE DEED, debt or mortgage of the home and that she holds no more interest but in the event a signature is needed for validation purposes and strictly to do with that property that the POA say it is okay for you to sign for her.

    4. along with that Get a Quick Claim Deed for her to sign also, this will prevent in the event you pay your mortgage off and or sell it she will not be entitled to any gain from proceed.

    5. Call the VA , and tell them what is going on. They maybe able to help you especially if the loan is VA Backed. The VA will not let your home get taken away but you need to reach out to them and tell them what is going on , because for all you know Nation whatever they are called don’t care enough to do so and they can just be a loan processing shuffling paperwork.

    6. look up your county info, get a paper trail of your title chain. and put it in your records for safe keeping, in the even Nation mortgage duh heads say hey you owe us money after you refinance with another servicer etc you will have validation that the mortgage was assumed refinanced and in your name with out the ex etc. and it will provide if in the event you sell the property a piece of mind for yourself and the new buyers that no funny business is going on.

    I am sorry to hear about your troubles with this, We just went through a horrible situation still going through and haven’t even began to litigate our retaliation, but My spouse is a Veteran, and I am disgusted how difficult is has been to get him help with his home financially, emotionally, and legally. Absolutely disgusted that in a time of need in the civilian world here that no one cares enough to obtain the “jurisdiction” to help Veterans. ‘

    Anyway thats my opinion, and felt truth of the matter.
