Wells Fargo is in a federal judge’s hot seat.

America’s largest mortgage servicer just lost the battle to keep its controversial Wells Fargo Home Mortgage Foreclosure Attorney Procedure Manual out of federal court in New York.

At a hearing in lower Manhattan on April 8, Judge Allan Gropper admitted the manual into the bankruptcy case of a local homeowner in foreclosure, and he approved a request by his lawyer to be allowed to dig deeper.

    If this manual was published in 2011, what about foreclosures that were illegal prior to, when you can with utmost certainty prove WFHM didn’t have the note prior to commencement of foreclosure? The faulty assignment of mortgage dated after commencement of action, so this reveal of a manual to fabricate docs is straight criminal and somebody needs to go to prison, straight up!!!

    Wells Fargo was doing this crap well before 2011 and that been provided to the SEC, HUD, Justice and FBI because after Sept 25, 2008 Washington Mutual Bank was dead and Wells was servicing 1.3 million of that bank loans that had been placed into securities!

    Between DocX & MERS you got millions of Forgeries to place these servicers in Title illegally!

    Wells had no paperwork to show they were entitled to foreclose. They may not have had a formal manual but they sure had procedures in place set up by the higher ups. Things may have gotten more complicated as time went on and the HO started to get a clue. My hunch is there was always something written on how to fabricate the docs from the very beginning. There had to have been not only with Wells but other banks as well. Just love that endorsement in blank showing up months after the foreclosure stated. In my case the endorsement was dated. And of course, Wells states nothing is wrong with this manual.

    @Charles Reed check out the manual on page 17 it is clear instruction to the foreclosure atty to execute an endorsement on the note when there was none prior.
