High Court rules for homeowners: Beware of dishonest bankers and mortgage servicers – MERS NOT a BENEFICIARY

In home foreclosure cases the banks have contended that Mortgage Electronic Registration Systems is the beneficiary. Now, in a 21-page opinion issued Nov. 25, 2013, the Montana Supreme Court held that MERS is not the “beneficiary” under Montana’s Small Tract Financing Act. The decision is now the law in Montana.

Just to recap, the illegal fraudulent actions committed by banks are the use of “robo signers” (individuals forging executive signatures on documents); the use of fraudulent documents; and the separation of your deed from your note via MERS.

In researching illegal home foreclosure cases, results show that in state after state, court decisions favor of the homeowner, not the bank.

  1. Except Idaho. What is wrong with the Idaho courts? Idaho Supreme Court rules MERS is a beneficairy. I can not imagine how they come to this ruling except they are as corrupted as it gets. Or possibly not to smart! Just my opinion.

    Shelley: I do know this…NW Trustee Services aka Routh, Crabtree & Olson of Spokane, WA use First American Title in Boise, ID to churn out foreclosure sales. I am in the State of Montana and they, in cahoots with Residential Credit Solution and JP Morgan, made FATCO the named Successor Trustee as FATCO in Boise, ID. FATCO of Boise said that they have a “special arrangement” with NWT. Whatever that means. The FATCO Corporate office in Santa Ana, CA states otherwise. They have stated to me three times now that NWT is NOT and AGENT OF FATCO…Yet, NWT was sending me correspondence as an agent of FATCO. Some are also finding that here in Montana a number of the title companies that were part of this big mortgage scheme were NOT LEGIT.
