1. On behalf of the putative class, Plaintiff alleges a violation of the Fair Debt Collection Practices Act, 15 U.S.C. § 1692 et seq. (“FDCPA”). Simply put, Defendant sent a demand letter to Plaintiff and the putative class which failed to comport with the mandated requirements of §1692g of the aforesaid federal statute.

    Daniel Consuerga was hired by bank of america and foreclosed on my home.

  2. Barbara Leahy Power of Attorney (as of March 2015) when found she was unable to manage her financial affairs says:

    Beverly Rutledge received a letter/ followed with a call from Attorney OwenBoyce in the law offices of Daniel C. Consuegra, P.L. 7/3/2013 telling her, he would represent her to negotiate with the creditors in her accumulated debt for the amount of $25,343.00. She was advised from Attorney Owen Boyce that it would require him to need a notorized Power of Attorney from her so he could make the negotiating process to the Creditors. This was done and Owen Boyce withdrawing $429.95(via monthly automatic withdrawal) from her account from 7/2013 through 1/2014. Due to lack of funds in her account to meet her living needs Beverly called Attorney, Owen Boyce to cancel this contract. Beverly has a confirmation cancelation letter dated 2/14/2014 from Attorney Owen Boyce. The following is what she told me (Barbara Leahy her designated POA) what she said to him. Beverly asked Attorney Owen Boyce if he was able to reduce her debt. He replied that he had not contacted the creditors yet because he was waiting to accrue more escrow into the account so he would have better negotiating power to reduce her debt. The dollar amount withdrawn by Attorney Owen Boyce from Beverly checking account was $3004.35 for no services provided. She did not recover any of the money paid to him. Please advise.
