80. The class of persons Plaintiff seeks to represent are those owners of “owner occupied” residential structures or condominiums (or who have an interest in such real property) who’s mortgage loans are serviced by Defendant, and who have been injured by Defendant’s pattern of systematically, violating and circumventing the provisions of RESPA (12 U.S.C. Section 2605(e) et seq.), and the FDCPA (15 U.S.C. § 1692(c) et seq.), as well as New York GBL § 349 within one year from the date of the commencement of this action.

81. The central questions in this litigation relate to the Defendant’s pattern of practice whereby (a) it systematically and deliberately violated and circumvented the provisions of RESPA (12 U.S.C. Section 2605(e) et seq.) by (a) its complete failure to respond, or its inadequate responsiveness, to QWRs, as well as its timeliness of responses in providing the information in response to QWRs, (b) by Defendant’s failure to remove information regarding any alleged overdue payments, to consumer reporting agencies during its review of said QWR’s, and (c) for Defendant’s violations of the FDCPA (15 U.S.C. § 1692 et seq.) in circumventing Plaintiff’s attorney(s) by corresponding directly with the mortgagor instead of Plaintiff’s attorney(s) in responding to QWRs. It is alleged that Defendant’s violations of the aforementioned statutes resulted in damages to the Plaintiff, as well as the class she seeks to represent, in the form of (a) statutory violations as well as (b) actual damages as mentioned hereinabove.

    I am looking for an attorney to file suit against Citi mortgage concerning Deceptive Acts and Practices (UDAP). I am in Louisiana and have been dealing with Citi for almost 3 years now while in bankruptcy and have a very think file with NO answers and many many inconsistencies. Citi has not attempted to foreclose, in fact have done nothing delay.

    Have been trying to work out modification since 2009. I have filed the required paperwork no less than 10 times, have been put on- and successfully met – at least four different “trial periods” where our payment was raised more than $400 monthly. House has been sold at sheriff sale; no one has contacted me; when I called Citi to inquire about a short sale, I was told that the “file is locked. We’ll have to send a request to IT to have it unlocked to see if you can qualify for a short sale. The file has been locked since April when you filed the modification.” The LAST modification was filed in July. :/

    All this is the same story I have and in the meantime has demolished my credit! Has anyone won in these lawsuits? Or, is it just more work to waste my time and stress me out more? They have approved me of my second “trial period” but while I was trying to get a modification to lower my payments it has been raised almost $400.00 and the reasoning behind that is taxes and ins. goes up??? I highly doubt it went up that much. They have put me on hold for almost 4 years now all the while not letting me make a payment except during my first trial period that had dropped my payment $400.00. I am sick and tired of being sick and tired and them telling me they need this paperwork because they cannot find in file (once every month they say this) I find it hard to believe they are losing such important documents and if they are I am doubled stressed knowing my personal info. is out there in someone else’ hands! Please help if you know if this law suit is successful and worth more stress time!
