  1. A denied/stalled loan modification provides an excellent foundation to press the lack-of-standing issue of the pretender-lender: TO ENGAGE IN MEANINGFUL MODIFICATION NEGOTIATIONS, IT IS NECESSARY TO DETERMINE THE BANK’S AUTHORITY TO ENTER INTO ONE. Also, a lack of authority to modify likely explains repeated denials of a mod even where the person qualifies.
Thus, no one is trying to get a free house, but the lack-of-standing point is raised to achieve the common good (encouraged by the government) of entering into a loan modification agreement.

One would also have to ask why the conflicting dates of execution on this document? Nearly a month apart? Why weren’t they executed at the same time? If you’re going to impeach, nail them on everything!
Chain of title issues are created this way. Check ejectment statutes for cases similar to Titus v. Tolle as comparison. If title issues are present, case cannot be summarily dismissed.
