The Court notes that the same law firm, Steven J. Baum, P.C., represented both HTFC and Wells Fargo as plaintiffs.
Moreover, Mr. Wider avers that “Jeffrey Stephan,” who purportedly executed the assignment as “Limited Signing Officer” of HTFC Corporation, has never been an employee of HTFC and that such person was never authorized to act as a “Limited Signing Officer” on behalf of HTFC for any purpose.
Wells Fargo does not have standing to maintain and prosecute this action to foreclose defendants’ mortgage. Plaintiffs have failed to come forward with any evidence to substantiate its claims herein or to raise a triable issue of fact. Indeed, the affirmation of plaintiffs attorney, sworn to September 8, 2010, reflects that plaintiff has been unable to locate any documents substantiating plaintiffs “belief’ that “its servicer had the authority to execute any and all documents attendant to the transfer of the loan.”

Finally A judge who gets it. What about all the ones that don’t? What about all the homeowners that already suffered the greatest of all loses? The ones who already lost their HOME by the hand of Jeffrey Stevens or crystal moore or bryan bly? Those low level low thinking people who’s job title is signer…they should spend some time in jail too-but the real culprits- the big banks and all of their friends and affiliates need to spend some serious hard time. Before they are locked away, I pray this sunday they are left homeless and scared everyday and they have no trust or no hope left. Now that’s hard times. How long Will our official continue to allow this outright rape? If our officials that are elected for us….(remember WE the people) —cannot see the mass fraud by now-they all need to be fired. How stupid can they ALL be? Atleast one crooked judge is moving ….bye bye meenu sasser. Hope you do better with the ” criminal” division. U couldn’t seem to identify the criminals before, but good luck with that . Thank God for something. Debi
