These are excellent words…

It has been brought to my attention that a number of states have alleged in court filings that MERS intentionally failed to pay recording fees and failed to disclose the transfer and assignments of interest in property, solely to avoid and decrease the recordation fees owed tot he counties and the state.

    Huh,”intentionally”, ya think? And how do the customers/citizens of those states access the records that the AGs are reviewing? Its costing the average customer/citizen of Hawaii an average of $35 to recover documents that actually have been filed and most are floating robosigners only found through title company research because its not linked to the customer/citizen only to the the tax map key number… and that doesn’t include each and every servicer change that isn’t filed.

    This is something that has perplexed me for months now since I began to hear of this problem. Why don’t the foreclosure defendants look into the state/county to which a mortgage assignment was transferred, and contest the chain of custody of the title and the validity of the plaintiff’s standing due to the broken chain as a result of a failure to record the transfer on the day it was alleged to have happened. This would almost certainly be enough for a judge to have no choice other than dismiss with prejudice and refer the matter for criminal fraud prosecution.

    Beau Deters: They don’t because it does not work in the courts, read a lot of the articles and you will see, they will not show the papers and the judges say that is irrelevant. Like you said, you recently had been aware of this and there are 310 Million people in this country, where in the Free education did they prepare Americans to even know they can pass laws with out votes from Americans
