I would like to know what can I do to keep my house ,since my mortgage company
dragging me around with the excuses of loosing or not receiving my documents ,via fax,or even register return mail.Since January first 2010 they set me for 3months of trial forebarance ,that would qualifying me to modification.
They told me if you don’t hear from us ,keep on paying ,evetualy I start calling them.
everytime I called they asked for more documents, which I sent in My payments up todays date paid one or two days ahead of the time.
On Sept.21.2010 they called and after the call, sent me the deniel letter which says my income is only $2100.00 per month and I’m not qulified for affordable program, since all mu tax return ,and bank statements showes the income more than what makes the aligibility for modification.what shoud I do that I can save my home? This is a Loan servicing company, not abank.
Hello,
Do I just give up?
Any advice AT ALL will be welcomed – positive or negative…
November 2008 – Countrywide calls me, as a homeowner, asking if I would like to decrease my mortgage payment by $350. Of course. Who wouldn’t say yes?
Up until this point I HAD NEVER MISSED A PAYMENT. NOT ONE.
“Since you are interested we are going to put you on the list – we will contact you in March 2009.”
They called in March and took all my info and said basically, “if you qualify and you make three months payments on time your mortgage will be modified.”
I paid for 18 MONTHS, never hearing from them until August of 2011, stating that I do not qualify!
I started a long UPHILL battle at that point to show I was and am qualified (working with local housing – CEDA) to show documentation of such.
IT has been over FIVE years, over 35 court appearances, 7-8 re-modification denials, many, many letters to various lenders my mortgage was sold to: Countrywide>BoA>Greentree>Ditech and I finally have rec’d a re-modification from Ditech!
I have finalized my re-mod with Ditech however, within this re-mod is included almost $50,000 fees, interest and arrears.
Paying the back payments would be completely fair and that is not the issue. The issue here is that the interest and fees should NOT be added onto the back of my mortgage.
Do I have any recourse?
REMEMBER, I did not initiate the process, NOR WAS I EVER LATE ON A PAYMENT in the history of my mortgage with Countrywide!
I was never removed from my home even after foreclosure proceedings were started multiple times, because I WENT TO COURT (over an hour away) every month to keep the foreclosures from happening.
Again, is there any recourse?
Thanks for any reply you can offer!
